Requirements for Use

Every customer of GoldBack2Cash must be at least Eighteen (18) years of age in order to conduct any type of business with us. You must be the actual owner of the gold and jewelry that you would like to sell and we ask that every customer act on his/her own behalf. You must not be an agent or representative for the actual person who owns the jewelry.

GoldBack2Cash may, but is not required to or obligated to, request the necessary documentation that would prove the customers compliance of any of the requirements in this paragraph.

Guarantee against Loss of your Gold and Jewelry

GoldBack2Cash will guarantee against the loss of the total contents of your package, however, all contents must be properly packed and shipped according to guidelines, procedures and instructions established by GoldBack2Cash. If the total value of your items is greater than $100, we recommend that you insure your own package. Please remember that our insurance company will require proof of what items are in the package and that these items were actually sent to GoldBack2Cash. A Tracking verification of your mail package can be obtained by your local United States Postal Office. Without a USPS tracking number, it is impossible to verify that your package was sent to GoldBack2Cash and will therefore be invalid to receive the $100 guarantee of lost items during the mailing process.

The liability of GoldBack2Cash will be limited to one-third (1/3) of the value of the total content or $100 dollars, whichever is less, and GoldBack2Cash must obtain proof form of an original sales receipt or a certified appraisal by a certified appraiser. If you do not include an original sales receipt or a valid appraisal from a certified appraiser, then GoldBack2Cash’s liability will be limited to Thirty-three dollars ($33).

This Guarantee only applies to merchandise shipped in the original Tyvek packaging supplied by GoldBack2Cash.

GoldBack2Cash reserves the right, in our sole discretion, to reject the delivery of any mail or package or envelope that appears to be damaged, tampered with, opened or partially opened. GoldBack2Cash will have no liability to any customer if the mail, package or envelope is returned under these circumstances. We do not insure your items; such insurance may be purchased by you. You hereby understand and agree that we shall not be liable for any loss in excess of $100 and you hereby waive any claims to recover for additional damages resulting from the loss or destruction of your Items.

Limitation of Liability

This limitation of liability shall be binding on each and every customer and any third party, including, but not limited to, the customer and the customer's successors, assigns, insurance carriers and any other individual or entity asserting any right or claim relating to customer's transaction with GoldBack2Cash.

In no event shall GoldBack2Cash be liable for any damages from the loss or destruction of property in its possession for any reason, including negligence, except as stated herein.

In no event shall GoldBack2Cash be liable to any third party, including any insurance carrier. GoldBack2Cash shall not be liable for any subrogation claim brought by the customer's insurance carrier, and, by submitting an item to GoldBack2Cash, customer expressly and specifically waives any such subrogation claim on his or her behalf as well as on the behalf of his or her insurance carrier.

GoldBack2Cash's liability is and shall be expressly and specifically limited to the LEAST of the following sums:

1. The liquidation value placed on the total contents by
GoldBack2Cash in GoldBack2Cash’s sole discretion.

2. One-third (1/3) of the appraised value of the contents
according to an appraisal submitted by a customer/seller to GoldBack2Cash, which appraisal was issued prior to the shipment of the item to GoldBack2Cash; and,

3. The sum of One Hundred ($100.00) Dollars.

The customer/seller expressly acknowledges and agrees that if there is no certified appraisal which was issued prior to the contents begin submitted to GoldBack2Cash, GoldBack2Cash's liquidated value shall be conclusive and binding and further, that in no event shall GoldBack2Cash’s Liability exceed One Hundred ($100.00) Dollars.

GoldBack2Cash shall not be liable to anyone for any damages, including but not limited to, incidental, consequential, punitive, loss of profit or opportunity, other than as set forth herein above. By submitting the items, customer explicitly and expressly accepts this limitation of liability.

If you believe your gold jewelry or other property is worth more than $100.00, we recommend that you insure your shipment for more at your own expense using any carrier you choose. We also strongly advise that you list the contents of your mailing kit on the enclosed brochure, which you must return to us.

Verbal Offers

Any customer or prospective seller may request GoldBack2Cash to provide a telephone or e-mail quote for his or her items after such items have arrived at GoldBack2Cash processing facility. Verbal offers may, at the discretion of GoldBack2Cash, be recorded. Upon a verbal acceptance by the customer of the telephone or e-mail quote, payment will be issued by GoldBack2Cash within twenty four (24) hours of such acceptance, and the ten (10) day customer satisfaction holding period guaranty will no longer be applicable to such transaction.

Material Return

All items sent to GoldBack2Cash are secured at the processing facility for ten (10) business days from the date items are received at the processing facility. If you are not satisfied with the payment you receive for your items, you can return the check within ten (10) business days of the check date or contact us by phone within ten (10) business days of the check date and your items will be mailed back to you at no cost. Any items identified as being costume jewelry (not containing precious metals or stones) will not be returned to the client unless the client requests the items back by calling a GoldBack2Cash customer service representative no later than thirty (10) days from the date the items were received at the facility. All items will be removed from the processing facility ten (10) days from the date they arrived at the processing facility.

Return Insurance Limitation of Liability GoldBack2Cash will insure any item returned to you with a value of $50.00 or more, as determined at sole discretion of GoldBack2Cash, for two (2) times the amount of such value. The amount we determine at our sole discretion is regardless of whether you insured and the amount you insured the items for upon mailing. GoldBack2Cash will not insure any item with a value of less than $50.00. GoldBack2Cash will determine, at its sole discretion, the return carrier, insurance and receipt verification method for each transaction. GoldBack2Cash will have no liability whatsoever in connection with the return of any item to you except for above-stated insurance obligation.


Modification of the Terms and Conditions

The Terms and Conditions agreement is binding to all parties. It may not be changed or modified by any other means including written or verbally. GoldBack2Cash reserves the right to change this agreement on our website at any time. We realize that you may not be aware of any changes that we make to our Terms and Conditions so we recommend and expect you to review our website and all of its pages during the entire course of your transaction.
